GRIEVANCE AND LEGAL CELL

has been constituted by the General Body of APOS in 2008.
Any member, if he / she have any grievance falling within the terms of reference of this cell, is advised to contact any one of them for redressal.

Memorandum of Grievance & Legal Cell
Purpose of the grievance cell: To redress the grievances of the members the society arising out of their professional practice.

Name of the committee: The committee shall be called as grievance and legal cell.

Aims & objectives: Unbiased justice shall be done to the aggrieved members.

Constitution of the committee: The managing committee of APOS nominates the committee. The committee shall consist of one chairman and two members. One of them preferably shall be qualified in law. The chairman and the members should have been life members of the society for at least 15 years. The term of office shall be for 3 years. They can be nominated for maximum 2 terms.


Rules & regulations
  • Any aggrieved Life member of APOS shall send his grievance to the chairman of the committee by registered post.
  • The chairman in turn sends the letter to the other members of the grievance cell.
  • After receipt of the complaint the grievance cell shall meet or consult each other and give a reply to the complainant whether the complaint falls within the jurisdiction of the committee or not.
  • If the complaint is accepted by the committee, informs the complainant with in a month fixing a meeting with the complainant at an appropriate place and time.
  • If any other member of the APOS or any person of the public is mentioned in the complaint he or she shall also be called for the meeting.
  • The meeting shall be held in camera and the final verdict of the committee shall be informed to the people concerned with in 15 days after the meeting and also to the managing committee of APOS.
Jurisdiction and functions of the committee
  • Advice regarding professional protection against consumer protection act.
  • When a member complains against a surgical or a pharmaceutical company for cheating the member.
  • when there is a complaint by a member of APOS against another member regarding breach of ethics of medical practice.
  • when a member complains of threats to him self by another member or from the public.
  • Advice regarding professional protection against CPA : The aggrieved member can complain to the grievance cell when he gets a legal notice from a patient he has treated. He has to give all the details of the case. A copy of the legal notice shall also be enclosed. The committee will fix up the place, date and time and the complainant shall attend the meeting with members of grievance cell. The chairman of grievance cell shall inform the patient also to attend the meeting. After the hearing from both the parties the committee will come to a decision and inform the member and the patient about the merits and demerits of the case. If both parties are willing a compromise solution could be arrived.
    If the aggrieved patient has already gone to the court and the same ii informed by the complaining member the committee can assist in the defense of the member. If necessary the committee can co-opt one member belonging to the sub-specialty and take his advice to help the aggrieved member in preparing the affidavit to be submitted in the court.
  • When a surgical or a pharmaceutical company cheats a doctor the member can report the matter to the committee. The committee shall call the member and also the representative of the company. The committee after hearing both versions gives its judgment. If the company does not honor the judgment the committee shall write to the APOS and AIOS to black list the company and inform all its members.
  • When there is a complaint by a member of APOS regarding the breach of ethics against another member the committee shall call both the members and examine the evidence and report its decision to the managing committee of APOS.
  • When a member complains of threats to him self by other members of the profession or public the committee will try to mediate and do justice to the complaining member.
    The managing committee of APOS shall respect the decisions and recommendations of the grievance cell.
